Following to the Quebec regulations, the entrepreneur is defined as follows:

“entrepreneur”: a foreign national who has at least 2 years experience in the operation of an enterprise that the foreign national acquired in the 5 years preceding the date of filing of the application and comes to Québec

(i)    to create or acquire an enterprise to manage himself, or to participate as an associate in the management and daily operations of an enterprise, and control at least 25% of the equity, alone or with his accompanying spouse, including de facto spouse, that percentage being worth at least $100,000 if the enterprise is
-  an agricultural enterprise situated and operated in Québec; or
-  an industrial or commercial enterprise situated and operated in Québec that will employ on a permanent basis and for a minimum of 30 hours per week at least 1 Québec resident other than the foreign national and the foreign national's accompanying family members; or

(ii)    after acquiring, alone or with the foreign national's accompanying spouse, including de facto spouse, at least 25% of the equity, that percentage being worth at least $100,000, of an enterprise described in subparagraph i, to manage the enterprise himself or to participate as an associate in the management and daily operations of the enterprise;

“experience in the operation of an enterprise (entrepreneur)” means the actual assuming on a full-time basis of responsibilities and duties related to the planning, management and control of material, financial and human resources in a profitable and lawful agricultural, commercial or industrial enterprise of which the entrepreneur controls at least 25% of the equity, alone or with his accompanying spouse, including de facto spouse, provided that such responsibilities and duties are not assumed in the context of an apprenticeship, training or specialization process attested to by a diploma.

The Quebec selection procedure is also based on a set of selection criteria such as the following:
-    Age
-    Business experience (two to five years)
-    Education
-    Proficiency in French and in English
-    Former trips and relatives in Quebec
-    Financial Capacity
-    Adaptability: Knowledge of Quebec, evaluation of the business project (assessed during interview)
-    Personal net worth (minimum of $300,000.00 CAN)
-    Evaluation of the business project : the assessment will differ according to the type of business that is involved and whether the applicant will acquire  an existing enterprise or whether the applicant will create a new business.

The applicant is expected to have completed an exploratory visit in order to acquire information on Quebec’s company legislation and on the sector of business related to his project. The steps that will have been taken will be important to demonstrate that the applicant’s business is viable and based on a thorough investigation.
The origin of the personal net worth will be evaluated in order to dismiss any income or asset received illegally.

The Quebec application is submitted in Montreal or in Hong Kong depending on the country of residence. Once approved by the Quebec authorities, a separate federal application is submitted in order to process the medical and security clearance.

Upon arriving in Québec, the entrepreneur must comply with one of the options indicated above, for at least one year during the three years after obtaining permanent resident status to create or acquire in whole or in part the business with a value of at least $100,000.00 CAD, employ a resident and participate in the daily management of the business.
